Seller Rip off

I purchased mikimoto pearls from thewatchclinic-power seller and all the good stuff.  Within a couple of days after recieving them I became seriously ill for almost three months. By the time I went to have them looked at for my insurance I found out they were fakes.  I emailed the seller-no resonse-Ebay could not help because of the time limit.  I went to Square deal to try to negotiate and got nothing.  I have emailed several time with absolutely no response from the seller.  I cannot believe he is a power seller with ebays backing and wont even do me the curtesy of an email.  Though it is not his fault my illness caused a delay-is there a time limit on honesty?  How can we protect ourselves, I am going to file a police report but the seller is in Georgia while I am in Maryland.  He even used authentic Mikimoto packaging and the clasp for this stinky business.  How did he get a Power Seller rating?  How can buyers protect themselves from the rare unforseen circumstance like illness?  Shouldn't our ebay community be able to do something.  The last message I sent he was going along with his business as ususal.  My husband saved for that very special gift for me-we are not rich-he knew it was something I always wanted and this seller made his beautiful gift a terrible experience.  ANY IDEAS-Any would be welcome-HELP FELLOW EBAYERS-chris

well, i know this is a sucky deal but if this happened with a store like walmart would they be liable to take it back because of your personal stuff? NO. They have a time limit..all stores do and nothing that you are going through cjanges that. I think it sucks but it s the rules. And making a police report for what? You bought it. YOu didn't have it apraised..it is not their fault you were sick. (nor yours but it is your responsibilty in any event)They did nothing wrong to have a police order filed and to be honest, when the police find out you entered into a binding contract (which you do everytime you bid) tand that there is a time limit for returns, they will say they have nothing to file. Goodluck though. Unfortunately, lesson learned here, is no matter how sick, send someone to apraise when buying an espensive item. This really stinks.. Sorry :(

Geez whit...kind of a harsh response...or am I missing something? No, it was a harsh response. Also..I am not siding with anyone and am not implying that a crime has been committed. The buyer asked for advice/help and my response is based soley on their comments and should not be construed as condemnation of the seller as I have no way of knowing who is at fault.

If the buyer was guaranteed authentic Mikimoto pearls and the seller is using Mikimoto packaging to pawn fake Mikimoto pearls, then a crime has been commmitted. Unfortunately for the buyer, most stores do have time limits on returns and that's that. However, filing a police report is just the thing to do if the seller is selling knock-offs. The buyer could also inform the Mikimoto company that someone is selling knock-offs with their name on it. If the seller is above board then he/she has nothing to fear. Also, I would expect a seller to respond to a customer's e-mail. After all...aren't they supposed to be our valued customers? What if the seller is being sold fakes by their supplier, wouldn't they want to know and shouldn't they appreciate being tipped off by a customer who found out? It's impossible for us to figure out who did what here, or why things aren't being handled right, but something is definitely wrong. You did make some good points though. The buyer should have had these checked sooner. Even if a friend or relative weren't available, many appraisers accept deliveries. Ah well...as you said...live and learn.

Hello, the first response is non-sense. I would contact the FBI and relay the story, that is a crime and should be investigated. Fake Gucci, Prada, etc items are protected by trademark rules, and Mikimoto as well.Ebay is full of it in these kinds of cases. The FBI should be very interested. Thanks

While there may be a time limit on returning an item, the Statute of Limitations for fraud is at least 12 months. I suggest taking the fakes to a reputable Mikimoto retailer and asking them for a letter stating the ones you received are fake. Send copies of the letter and the seller's false claim to the Mikimoto Company, no doubt they want to protect their company’s reputation and will address the problem.

Find out the name and address of this crook. If you saved the package in which the pearls were sent and he used the USPS, contact the postal inspectors and report the fraud. If not, contact the Attorney General in the state of the crook. You can also hire an attorney and sue the crook for fraud and sue for punitive damages. Lot's of options for you. Do not silently remain a victime.

As several of these folks have stated you DO have a LEGAL claim against this jerk! Your being ill has nothing to do with this guy being a FRAUD! In Myrtle Beach SC, a few towns away from me, just last week, they ARRESTED a store owner for selling knock off Coach, Prada, Gucci, Harley Davidson, and the list is to long to name, merchandise. He is being charged with a number of charges, the largest being TRADEMARK FRAUD! They confiscated the remaining $450,000 in merchandise out of his store, and he is in JAIL! At Darlington Raceway, in my town, they ARREST vendors every year for trying this same thing. Just because he is on E-Bay does not make him immune or make it any less a crime. If you have something in writing that the pearls are not what he sold them as, and you have the box saying that they were supposed to be Mikimoto, then you have him by the short hairs, for a lack of a better term. I would persue this to the enth degree unless he gave me my money back. I would send him one more e-mail & inform him that if he didn't refund my money, PROMPTLY, that you will be contacting the Georgia Bureau of Investigation (because that is who would get you in touch with their Tradmark Fraud Division), and see what he will do then. If it is like one said and maybe he is being taken as well, then he will help you prosecute the people that sold them to him as being Mikimoto. Either way, you should get your money back immediately. I really think I am going to stop using E-Bay at all because I have just been taken again for the THIRD TIME on Tanzanite (Thank GOD I got my money back all 3 times though) ..... I have been searching for over 20 months for the perfect Tanzanite for my 25th wedding anniversary present, and have gotten everything from 1/2 the size stated, 1 with 3 cracks in it, 2 that weren't Tanzanite at all and the list goes on. There just are some people out there that have to ruin it for the rest of us because they just aren't HONEST PEOPLE. I feel for

Thank you so much for your help, I will follow the advice except of the first comment-I don't think walmart sells Sony products that are really fakes. This was fraud, and very slick-all the tags from Mikimoto and the packaging are genuine. I have reported this to Mikimoto and will be sending it to them for final verification. This is theft pure and simple-thank you so much for your support (except for the first one who did not get it-it is not the return of a genuine item, it is a FAKE)-again thank you for your support and great ideas, I will follow up, sincerely, chris
